01What Pool HQ is

Pool Headquarters is a pool-care planning and record-keeping tool for pool owners. You enter water test results and information about your pool. Pool HQ organises them, tracks your history, and calculates suggested chemical amounts and maintenance timing from what you have told it.

02What Pool HQ is not

This is the most important section in this document.

• Pool HQ is not a substitute for professional pool service, and not a substitute for your own judgment.
• Pool HQ does not test your water. Every calculation depends on the readings and the pool volume you enter. If either is wrong, the amount Pool HQ suggests will be wrong, and Pool HQ has no way to know.
• Pool HQ does not know your specific products. Pool chemicals are sold at different strengths and with different directions. The label on the product in your hand governs. Pool HQ’s suggested amount should always be checked against and used consistently with the product label.
• Pool HQ is not a safety-certification system. It does not certify that water is safe, that a chemical is safe to handle, or that a pool is safe to enter.
• Pool HQ does not provide medical, health, or other professional advice.

03Chemical safety

Pool chemicals can cause serious injury. You are responsible for handling them safely.

• Read and follow the label and safety data sheet for every product you use.
• Never mix pool chemicals with each other. Never combine chlorine products with acid.
• Wear the protective equipment the product’s label calls for.
• Keep chemicals away from children and pets, and store them as the label directs.

04Swimming decisions are yours

Pool HQ may show a swim-readiness status based on readings you entered. That status is a summary of your own numbers at the time you entered them. It is not a certification that the water is safe, and it cannot account for anything Pool HQ was not told or cannot see.

You decide whether anyone enters your pool. Supervise swimmers at all times. Never rely on Pool HQ alone for a decision about a person’s safety in or near water.

05Your responsibilities

You agree to:

• enter accurate readings and an accurate pool volume, and update them when they change;
• read the product label before adding any chemical, and follow it where it differs from Pool HQ;
• keep your own backups of anything you would not want to lose (see section 7);
• use Pool HQ only for a pool you own or are authorised to maintain;
• use Pool HQ lawfully, and not attempt to interfere with, overload, reverse engineer, or gain unauthorised access to it.

Pool HQ is designed for residential pools. It is not designed for commercial, public, or otherwise regulated aquatic facilities, which are subject to requirements Pool HQ does not implement.

06Early Access

Pool HQ is currently offered as an Early Access release. Features may change and you may encounter defects. Early Access does not reduce your responsibility to follow product labels and use your own judgment, and it does not reduce our responsibility to describe accurately what Pool HQ does.

07Your data, and backups

Pool HQ stores your pool data on your device. It does not currently require an account, and it keeps no copy of your pool data on our servers.

• We cannot recover your data. If you clear your browser storage, lose or replace your device, or uninstall the app, your history is gone and we have no copy.
• Export a backup regularly from Settings. The backup file is yours.
• What leaves your device, and when, is described in our Privacy Policy.

08No fee

Pool HQ is currently provided free of charge. If we introduce paid features in future, we will tell you before any charge applies, and these terms will be updated.

09Intellectual property

Pool HQ, its content, and its design are owned by VomZZZ Pool Solutions, LLC. You may use Pool HQ for your own pool. You may not copy, resell, redistribute, or create derivative works from it.

Your pool data is yours. We claim no ownership of the readings, notes, photos, or history you create.

10Feedback you send us

If you send us feedback through Tell Pool HQ, you allow us to use it to improve Pool HQ without obligation or payment to you. Please do not send us anything confidential, and please do not include sensitive personal information in a feedback message.

11Availability

Pool HQ may be unavailable, interrupted, or discontinued at any time. The weather and report-reading features depend on third-party services and may stop working independently of the rest of the app. We do not guarantee that Pool HQ will be available or that any feature will continue to exist.

12Disclaimer of warranties

POOL HQ IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT POOL HQ WILL BE ACCURATE, UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR YOUR POOL. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13Limitation of liability

To the fullest extent permitted by law, and except as stated in section 14:

• We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, or loss of use, arising out of or relating to your use of Pool HQ.
• Our total liability for all claims relating to Pool HQ will not exceed the greater of the amount you paid us for Pool HQ in the twelve months before the claim arose, or one hundred United States dollars (US$100).

This limitation applies regardless of the legal theory on which a claim is based, and applies even if a limited remedy fails of its essential purpose.

14What we do not limit

Nothing in these terms limits or excludes our liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation;
• any other liability that cannot be limited or excluded under applicable law.

Some jurisdictions do not allow the limitation of incidental or consequential damages, so the limitation in section 13 may not apply to you in full.

15Indemnification

You agree to indemnify and hold harmless VomZZZ Pool Solutions, LLC and its members, managers, employees and contractors from third-party claims, damages and reasonable costs arising out of:

• your breach of these terms;
• your violation of any law or any third party’s rights; or
• your use of Pool HQ for a pool you are not authorised to maintain, or for a commercial, public, or regulated aquatic facility.

This section does not apply to any claim arising from our own negligence or misconduct, and it does not require you to indemnify us for anything described in section 14.

16Resolving problems

Please contact us first. Most problems are quicker to fix directly than through a formal process. Write to support@poolheadquarters.app and describe what happened. We will try to resolve it with you.

Contacting us first is a request, not a condition, and nothing in this section limits your right to bring a claim.

We do not require you to arbitrate, we do not ask you to give up your right to participate in a class action, and we do not ask you to waive a jury trial.

17Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.

Nothing in these terms deprives you of the protection of any mandatory consumer-protection law of the place where you live, or of your right to bring a qualifying claim in your local small claims court.

18Changes to these terms

We may update these terms. If we do, we will update the effective date above and, where a change is significant, tell you in the app. If you do not agree to an updated version, please stop using Pool HQ.

19Miscellaneous

• Severability. If any provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest remains in effect.
• No waiver. If we do not enforce a provision, that is not a waiver of it.
• Entire agreement. These terms, the Privacy Policy, and the Pool Care & Safety Disclaimer are the entire agreement between you and us about Pool HQ.
• Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition, or sale of assets.
